The terms and conditions will apply to each member who wishes to use the DentinalTubules.com website and its related services and functions. Each member must adhere to these terms and conditions in order to access and use the www.dentinaltubules.com website and participate in the discussion forums. By using the website it is deemed that you accept these terms and conditions.

Members mean any person, company, organisation or firm that use any of the services provided by www.dentinaltubules.com

1.1 Data Protection

Our use of CVs and other personal information supplied by users of this site is governed by our privacy policy.

1.2 Use of Site

The information and services available on the site are provided solely for members for the purposes of
- searching for employment, training courses and businesses in the database
- placing classifieds regarding vacancies and training courses
- discussions on forums
- reading articles and news

1.3 Limitation of Liability

Our liability, and the liability of our third party suppliers, for any loss or damage suffered by you as a result of your use of this site is limited to your own personal actual direct damages, and except in the case of fraud, excludes any loss of future earnings, profits or prospects or any consequential or speculative loss. As required by law, this exclusion does not extend to death or personal injury cause by our negligence.

The website owners and the website do not warrant the content, accuracy or veracity of any material or other information on the website, the responsibility of which rests with the Members as specified in section 1.5

Each subscriber accepts the website “as is” with any faults or failings, and without any respresentation, warranty or guarantee whatsoever, express or implied, including without limitation any implied warranty of accuracy, completeness, quality, merchantability, fitness for a particular purpose or non-infringement.

In no event will the website or website ownersules be liable for any injury, loss, claim, damages or any special, incidental, consequential, exemplary or punitive damages of any kind arising out of or in connection with a member’s access to, or use of the website, any material thereon or any goods, materials, or services available therefrom, whether based in contract, tort and whether negligent or otherwise even if any website owner has been advised of the possibility of such damages.
In the event that this exclusion of liability is held by a court of competent jurisdiction to be unlawful, but the liability may be lawfully limited, the website owners aggregate total liability to any member for all members suffering loss during a specified time period (usually 12 months) preceding the event giving rise to liability.

We accept no responsibility or liability for the contents of CVs or advertisements and expect candidates and prospective employers to carry out such verification procedures as are usual and appropriate.

The website owner will manage and oversee the website. An administrator will oversee the forums and postings on the site. The administrator will also be responsible for the Complaints procedure as outline in section 1.6 below.

1. 4 Service Availability

We try to provide continuous availability of the site but do not accept responsibility for the consequences of any interruptions or delays, however caused. We may alter the design and specification of the site at any time.

1. 5 Specific Responsibilities and Rules for members

- Each member is solely responsible for the accuracy, legality, currency and compliance of its own material and will be solely liable for false, misleading, inaccurate, infringing or other actionable material contained or referred to anywhere on the site

- Members must practice an ethical and moral standard when expressing their views

- Members must ensure that any information posted onto the site is not libellous, offensive or defamatory

- Members may print or download information from the site for the purposes outlined in section 1.2 only, and for no other personal or commercial purposes. Members are not allowed or permitted to otherwise copy, display, transmit or distribute any material from the site.

- Members must abide by all the rules outlined in sections 2.24, 2.3 and 3.1 at all times

- Each member agrees to indemnify and keep indemnified the website, the website owner , any related third parties and administrators from and against any and all liability, damages, losses, claims (including reasonable legal fees) resulting in any way from its use of and from any material posted on this website, to its discussion forums or from any other matter relating to it including but not limited to the use of information contained on the Website.

- Each member waives any right to bring any claim or action against the website, website owners or related third parties for any loss, damage or injury arising from the use of the website or any material from the website or from these terms and conditions.

- Each member is solely responsible for maintaining the confidentiality of their unique logon ID. Passwords are for the sole use of the person to whom they are issued. We may deny access to a password if we believe that it is being used by an unauthorised person or that the user is breaching the terms and conditions.

- Members acknowledge that they do not acquire any rights in the database or its content and that their retention and use of the database and its content is governed by these terms and conditions.

- It is the member’s responsibility to ensure that they have the appropriate equipment and are connected to the appropriate services to enable to access and post onto the website

- Where members collaborate with one another as a result of use of this Website or forums, they do so as independent contracting parties. Subscribers acknowledge that the website owner, website or administrator will not in any way be construed as a party to such collaboration nor be liable nor responsible in any way for the dealings of such collaboration or the parties to such collaboration.
Further it is for the members to ensure that any such dealings or contracts comply with the Sale of Goods Act 1979, Sale of Goods (Implied Terms) Act 1973 and the Consumer Protection (Distance Selling) (Amendment) Regulations 2005 and any other regulations and statutes or other applicable law whatsoever.

1.6 Complaints Procedure

The website forum is a self regulatory facility for members only. Members may report abuse if they are unhappy with any material posted on the forums. This can be done be done by using “the report abuse” link provided.

The website administrator will deal with complaints within 28 days of receipt and where necessary call upon evidence of the applicable members in dispute.

Once reported, any material deemed to be defamatory, libellous, inaccurate, illegal, non-compliant with the terms and conditions and rules (as identified in sections 2.24, 2.3 and 3.1) or offensive, at the discretion of the administrator, will be taken off the site with immediate effect and sanctions may be imposed upon the members.

Other sanctions available to the administrator will include one or all of the following:

- Expelling the guilty member
- Referring the matter to the appropriate law enforcement agency where the dispute is of a criminal or illegal nature
- Referring the matter to a court of competent jurisdiction if the dispute necessitates a judicial measure

1.7 Credit card payments

The website has some of the services that are free. For services that are not free to use payments are made by credit card using Paypal’s secure transaction environment. Please visit Paypal’s web site for more information.

1.8 Governing law

These terms and conditions shall be interpreted in accordance with English law and all disputes shall be decided by the English courts.

1.9 Confidentiality

The website owner and members may from time to time impart to the other certain confidential information about themselves and each party hereby agrees that it will not disclose such confidential information whether directly or indirectly to any third party. The foregoing obligation as to confidentiality shall not apply to information which has entered the public domain other than by breach of this provision by one of the parties hereto.

1.10 Terms and Termination

Each member agrees to remain bound by all the terms and conditions and rules (as amended from time to time) for as long as they remain members, and wish to use the services offered by the site, unless the website owner or administrator terminates, suspends or limits access to the website and its services in accordance with the conditions identified in this entire document or as is otherwise deemed appropriate.

1.11 Browser policy

The website supports the current and most recent previous versions of all popular browsers, and follows the XHTML 1.0 Transitional and CSS 2.1 W3C standards. If your browser is not supported, you may still be able to access our site, but you may encounter some display problems. Dentinaltubules.com also requires recruiters to enable session cookies in their browser.

2.1 Basic Rules

Each member and any content posted onto this website must comply with the following basic rules as well as the specific rules outlined in sections 2.24, 2.3 and 3.1

The basic rules that all members must comply to include:
a. All information and content posted must be legal, decent and truthful. It must not be defamatory, libellous or offensive in its nature. All information must comply with the responsibilities and rules identified in Section 1.5
b. Data Protection Legislation must be adhered to in order that the collection of personal information is not traded and disclosed illegally.
c. Distance selling legislation must be complied with

2.2 Job and Training Course Posting Terms, Conditions and Rules

2.2.1 Prices

Prices are confidential and may not be disclosed by the Customer. All prices are inclusive of VAT
The Prices and Credits systems will be shown prior to any transaction.

2.2.2 Job And Training Course Posting Expiry

A posting on the website will remain live for 30,60 or 90 days depending upon the option selected by the member at the time of posting. Any extension on the initially selected time frame will be charged to the member as a renewal. If a member deletes a posting and then either reposts it or posts another, this will be classed as two separate postings.

2.2.3 Job advertising

Job seekers and recruiters should be aware that this website operates as a venue only and we are not bound by The Conduct of Employment Agencies and Employment Business Regulations 2003 (the "Regulations"). We do not provide any introductory service or supply job seekers to recruiters, or recruiters to job seekers. This means we do not:

• obtain such information potential recruiters to select a suitable job seeker for the position which the recruiter seeks to fill;
• obtain confirmation of the identity of a job seeker or that they have the experience, training, qualifications or authorisation to work in the position to be filled or that they wish to undertake the role to be filled
• take any steps to ensure the job seeker and recruiter are each aware of any requirement imposed by law or otherwise which must be satisfied by either of them to permit the job seeker to fulfill the position to be filled;
• take any steps to ensure that it would not be detrimental to the interests of the job seeker or the recruiter for the job seeker to fulfill the position to be fulfilled;
• give any indication to recruiters whether job seekers are unsuitable (or suitable) for any position to be filled in any circumstances;
• propose job seekers to recruiters or provide any information about them.
• take up any references in relation to a job seeker; or
• make any arrangements for accommodation of job seekers.

The Regulations seek to ensure that work-seekers are only proposed by employment agencies for roles for which they are properly qualified and that recruiters are only offered work-seekers who have the appropriate levels of experience, training, qualifications and authorisation for the position to be filled. Since we are only a venue and do not propose or introduce work-seekers to recruiters or vice versa, it is recommended that, if you are a job seeker you undertake the steps set out in the Regulations to ensure your suitability for the role advertised or, if you are a recruiter, to ensure job-seeker suitability for the role.
Any searching tool provided by us for use in the assessment of the suitability or otherwise of any particular candidate or advertised vacancy are to assist you in taking these steps, but are not intended as a substitute.

2.2.4 Job Posting and Training Course Posting Rules

There are rules regarding the content and format of jobs posted Their purpose is to ensure that members who search the website or the dentinaltubules.com database get results which are presented as clearly and informatively as possible. Members agree that we may, at our discretion and without liability to you, remove from the website any advertisement which is posted in breach of these rules. The rules may change from time to time and you are advised to refer to them regularly.

The Rules are:
1. No duplicating of jobs or courses at the expense of other clients' jobs or courses.
2. No gratuitous use of keywords in the job or training course titles and descriptions. Gratuitous means deliberately inserting words, strings of words, or repeating titles, with the intention of influencing position in the results listing, or increasing the number of page views.
3. Job or training course advertisements placed on the website must be for genuine vacancies or courses only, and not for other products or services, either relating to or unrelated to recruitment including, but not limited to, affiliate schemes, pyramid selling schemes or any other so called 'business opportunity'. The same rule applied to training course advertisements as well.
4. URLs or email links (live or text only) in the body copy of the description must be live and working. The Website Owner, website or administrator do not bear any responsibility over the content of external sites.

2.2.5 Illegal Advertisements

Advertisements which appear to discriminate on grounds of sex, race or disability are illegal and may result in proceedings being taken against the respective members. If it believed that an advertisement may be discriminatory or offensive, administrators may at their discretion either amend the advertisement or remove it from the website without liability to members to make any refund of amounts paid or due to be paid in respect of the posting or otherwise. Members may be informed accordingly.

2.2.6 Responses to advertisements

Members agree to deal fairly and professionally with individuals who may respond to an advertisement posted and not do anything which may bring the website, website owner and administrator into disrepute. Members will indemnify the website, website owner and administrator from and against any claim brought by an individual against the website, website owner and administrator arising from members’ breach of this obligation or any other of these terms and conditions.

The website and website owners do not guarantee any response to advertisements or that responses will be from individuals suitable for the job or course advertised. It is the course provider’s and recruiter’s responsibility to carry out such checks and procedures as are necessary to ensure that candidates are suitable for the job advertised.
If a an advertisement generates no responses or if the vacancies are not filled, we WILL NOT refund your fee or credits that you have purchased.

2.2.7 Equipment

It is the members’ responsibility to ensure that they have the appropriate equipment and are connected to the appropriate services to enable to access and post onto the website.

2.2.8 Content and links

If your advertisement links to another site, members are responsible for maintaining the links and for the content of the advertisement and the linked site. Administrators may remove from the website any advertisement which contains content or links to a site which, in our opinion, is defamatory, illegal or objectionable or will bring our the website, website owner, administrator and Dentinal Tubules Ltd. into disrepute. Members will indemnify us from and against any claims or liability arising from content or links contained in your advertisements. The website, website owners and administrators are not responsible for the content of external sites

2.3 Terms, Conditions and Rules for Members Database and Active Member Search Rules

Employment Agencies and Employment Business Regulations 2003 are primarily for recruiters. Job and training course seekers and recruiters should be aware that this website operates as a venue only. We do not provide any introductory service or supply job seekers to recruiters, or recruiters to job seekers. This means we do not:

• obtain such information potential recruiters to select a suitable job seeker for the position which the recruiter seeks to fill;

2.3.1 Rights in the database

Database rights and all other applicable copyright and intellectual property rights in the candidate database belong to Dentinal Tubules Ltd. Members acknowledge that they do not acquire any rights in the database or its content and that their retention and use of the database and its content is governed by these terms and conditions.

2.3.2 Use of the database

The material members are entitled to receive from the candidate database is determined by the product that has been purchased from us. On receipt of this material members may:
i. Use, search or download it for the purpose of finding suitable candidates for specific job vacancies that they or their client wish to fill (if they are an employment agency or employment business).
ii. Use the information about the individuals contained in the database for the purpose of contacting them (either directly or through the website) in relation to a specific job vacancy.
iii. Use the information only in connection with recruitment-related activities.

Members may NOT:
i. Supply, sell or license material from the candidate database, or a copy of it, to any other person, including another member of their group of companies.
ii. Download the database through any automated (e.g. "scraping") process.
iii. Contact the individuals on the database or make or allow any use of the information about those individuals, other than for the purpose of finding suitable candidates for specific job vacancies. They must, at all times, comply with the Data Protection Act 1998 and all subsequent legislation and regulations.

2.3.4 Dealings with candidates

Members agree to deal fairly and professionally with individuals that they may contact using information from the candidate database and not do anything which may bring Dentinal Tubules.Com and Dentinal Tubules Ltd into disrepute. Members indemnify Dentinal Tubules.Com and Dentinal Tubules Ltd from and against any claim brought by an individual against Dentinal Tubules.Com and Dentinal Tubules Ltd arising from their breach of this obligation or any other of these terms and conditions.

3.1 Forum Rules

Member agree to abide by all the rules of posting on the forum and agree to be faced with the necessary sanctions (as identified in section 3.1.1) if the rules are not followed.
- Members must observe and learn about the content of previous postings in order to get an idea of what is acceptable
- Any foul, abusive or offensive language will not be tolerated. Such posts will immediately be removed and members expelled from the website
- Members are instructed not to post any content which is defamatory, libelous or offensive
- Members are advised not to forward virus warnings and the like to the forums
- Members are not allowed to promote themselves, any commercial interests or any spam

- Any consented records that are presented must be anonymised and make the patient non-identifiable
- Anything posted on the forum must be considered to be in the public domain.
- Members must not post anything for the following:
